TERMS OF USE

This document contains the Terms & Conditions of Cense and some important terms of Cense's Partners (as provided by them)

This Terms of Use Agreement is made by and between Cense and you i.e. Customer (hereinafter referred to as “the Customer/You/Your/Yours ” ). This Agreement contains the terms and conditions that govern Your use of this Website.

By accessing or attempting to interact with any part of this website or any of the services (collectively known as “services ” ) provided by Cense on its platform (including internet website and all its subdomains), You agree that You have read, understood and agree to be bound by this agreement. For the purposes of this Terms of Use, the term “Cense ”shall mean and include the Cense internet as well as all its subdomains. For the purposes of this Terms of Use, the term “Services ”shall mean and include credit card debt consolidation, Debt Assistance, Loan Transfer facilities and otherwise that the Cense platform makes available for You.

If You do not agree to be bound by this agreement, You shall not be allowed to access or use any part of this website. You have the right to raise your grievance for deactivation of Your account on Cense or choose not to sign up on Cense only at the initial stage of interacting with Cense, if You are not in agreement with any of the terms and conditions laid hereunder. The Privacy Policy and Grievance details are available in Privacy Policy statement

The subject headings used in this Agreement are included for purposes of convenience only, and shall not affect the construction or interpretation of any provisions of this document. In addition, for purposes of construing or interpreting this Agreement:

(a) unless the context otherwise requires, the singular includes the plural, and the plural includes the singular;

(b) unless the context otherwise requires, the masculine includes the feminine and neutral genders, the feminine includes the masculine and neutral genders, and the neutral includes the male and female genders

Cense provides to its probable Customers and users a platform to avail credit card debt consolidation and Loan Transfer through a third party. 

To access and avail the services of Cense, You may be asked to provide certain registration details or other information while signing up for a new account. You undertake, represent and warrant and state beyond any doubt that the information you provide on this site will be correct, current and complete in all aspects. 

That the Customer is required to sign up with a new account on Cense for which certain personal information shall be collected by Cense. Cense collects Personal Data that is voluntarily provided by the Customer such as the information when You sign up and log in to avail the Services on Cense, contact us with inquiries, register for access to the Website or purchase services from the Website. That such information is governed and aptly safeguarded by the Privacy Policy set by Cense available in Privacy Policy Statement and the same shall be read as an integral part of this Terms of Use. 

That the Customer undertakes that he/she is 18 years of age or older and is legally a Major so as to avail the Services provided by Cense. That Cense shall not be responsible and/or liable for any such misrepresentation by the Customer with respect to any of the Personal Data that the Customer provides. Cense reserves its right to refuse You access to Cense or any of its resources, and to terminate or suspend Your access and subscription at any time if the information You provide is found to be incorrect, not current or incomplete.

You may use the Services available on Cense for purposes expressly permitted by Cense. As a condition of Your use of the services provided by Cense, You warrant to Cense that You will not use the website for any purpose that is unlawful or prohibited by these terms, conditions, and notices.

You or any person authorized by You shall not co-brand Cense, frame Cense, download any content from Cense (other than as provided by these terms) without the express prior written permission of an authorized representative of Cense. You agree to cooperate with Cense to prevent or remedy any unauthorized use. 

Explanation: For purposes of these Terms of Use, “co-branding ”means to display a name, logo, trademark, or other means of attribution or identification of any party in such a manner as is reasonably likely to give a user the impression that such other party has the right to display, publish, or distribute this site or content accessible within Cense.

In addition, You may not use the Services in any manner which could disable, overburden, damage, impair or interfere with any other party ’s use and enjoyment of Cense. You may not obtain or attempt to obtain any materials, content, or information through any means not intentionally made available or provided for through the website.

In consideration of use of Cense, the Customer represents and confirms that the Customer is of legal age to enter into a binding contract and is not a person barred from availing the services provided by Cense and/or receiving the Services under the applicable laws of India or other applicable laws.

The Customer also understands that the services may include certain communications from Cense as service announcements and administrative messages. The Customer understands and agrees that the services are provided on an "as is "basis and that Cense does not assume any responsibility for deletions, mis-delivery or failure to store any Customer communications or personalized settings.

The Customer agrees that any and all damages, liability (criminal, civil or otherwise) qua the subject matter that might arise shall be the sole responsibility of the Customer. In addition to the aforementioned, the Customer undertakes to abide by the restrictions laid down in Clause 2 qua the subject matter. That the Customer agrees that the Customer shall borne all responsibility and legal liability in such an event.

Cense is for Your personal and non-commercial use, unless otherwise specified. You may not use Cense for any other purpose, including any commercial purpose, without the knowledge of Cense and without the express prior written consent by Cense. You may not modify, copy, distribute, display, send, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, content, software, products or services obtained from or otherwise connected to Censeor any other third party service providers, unless expressly permitted by these terms.

The material and content accessible from Cense, and any other subdomain owned, operated, licensed, or otherwise controlled by Cense is the proprietary information of Cense or a third party that provided this Content to Cense whereby Cense or such providing party retains all right, title, and interest in the Content, respectively. 

Cense uses certain third parties for the purpose of convenience so as to provide high quality content, payment and subscription services and to improve, promote and protect Cense services. Cense may use third party services to help provide customer support, manage our advertisement display, data storage assistance, payment gateways and many more.

You represent and warrant that You have read and agreed to be bound by all applicable Terms of Use and policies for any third-party websites. 

That links to such sites are provided as Services to users and are not sponsored by or affiliated with Cense. That the Links to such third party services, obligations, terms and conditions as laid down by such third party service providers are provided on Cense for the ready perusal of the Customer. That such links are to be accessed at the Customer ’s own risk, and Cense makes no representations or warranties about the content, completeness or accuracy of the sites linked to or from this site. The Customer undertakes agrees to hold Cense harmless from any and all liability related to Your use of a third-party website.

Cense reserves the right to monitor the use of Cense to determine compliance with these Terms of Use as well as the right to remove or refuse any information for any reason whatsoever that Cense deems fit. Cense reserves the right to terminate your access to any or all of the Services at any time without notice for any reason whatsoever. Cense also reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in its sole discretion.

Cense has made best effort to ensure that all information on Cense has been tested for accuracy. Cense shall take all reasonable and prudent technical routes as per industry practice so as to maintain the high standards of the Services to be made available to the Customer. 

Cense makes no guarantees regarding the results that You will see from using the information provided on Cense.

You understand and agree that You are fully responsible for Your use of the information provided on Cense. You understand that results may vary from person to person and user to user. Cense assumes no responsibility for errors or omissions that may appear on Cense.

You understand that Cense cannot and does not guarantee or warrant that the files available for downloading from the Internet will be free of viruses, worms, Trojan horses or other code that may manifest contaminating or destructive properties. Cense is provided on an “as is ”and “as available ”basis without any representations or warranties, expressed or implied.

Cense neither warrants nor makes any representations regarding the quality, accuracy or completeness of any data or information as the accuracy of the same are the sole obligation and duty of the third party based upon the information and details the third party provides Cense with. 

Cense makes reasonably and prudently possible efforts to ensure that the description and content on each page of the website is correct. However, Cense does not take responsibility for changes that occurred due to human or data entry errors or for any loss or damages suffered by any Customer due to any information contained therein. The Customer understands and agrees that Cense is not the service provider and cannot therefore control or prevent changes in the published descriptions which are based upon information provided by the third party.

The Customer agrees that Cense, its subsidiaries, affiliates, licensors, service providers, employees, agents, officers, and directors shall not be liable for any incidental, direct, indirect, punitive, actual, consequential, special, exemplary, or other damages.

Cense reserves the right, in its sole discretion, to terminate your access to any or all of Cense websites and the related services or any portion thereof at any time, without notice.

Upon termination of the Service, the Customer 's right to use Cense and its Services shall immediately stand cancelled and ceased. The Customer shall have no right and Censeshall have no obligation thereafter to execute any of the Customer 's uncompleted tasks. 

The Customer agrees that once the Customer 's registration or the Services are terminated, cancelled or suspended, any data that the Customer has stored on the Website may not be retrieved later.

The Customer shall indemnify and hold Cense, its subsidiaries, affiliates, licensors, service providers, employees, agents, officers, directors, and contractors (the “ Indemnified Parties ”) harmless from any breach of these Terms of Use by You.

The Customer agrees that the Indemnified Parties will have no liability in connection with any such breach or unauthorized use, and You agree to indemnify any and all resulting loss, damages, judgments, awards, costs, expenses and attorneys ’fees of the Indemnified Parties in connection therewith. 

The Customer agrees that it shall also indemnify and hold the Indemnified Parties harmless from and against any claims brought by third parties arising out of the Customer ’s use of the Services availed through Cense.

The Customer undertakes and agrees that any misuse of the Trademark or Copyrighted works displayed in Cense, or any other content on Cense, is strictly prohibited and may expose the Customer to legal liability under this Agreement/terms of Use.

The Customer agrees and understands that the customer is bound by the Terms and Conditions entered into with lending partners of Cense. The customer agrees and understands that the customer cannot remit and/or refund, in any case whatsoever such amount availed from the lending partner.
The customer agrees and understands that Cense has its own KYC registration process and policies that the customer has to adhere to at the time of making an account on Cense. The customer will be required to confirm his/her credit card details via a third party payment gateway, for which a transaction of ₹1 shall be done from the customer's credit card. The customer understands and agrees that such transaction is irreversible and no refund shall be given for the same. 

The Customer understands and agrees that any passwords used for Cense are for individual use only. You agree and undertake that You will be responsible for the security of your password. Cense will be entitled to monitor your password and, at its discretion, require You to change it. If You use a password that Cense considers insecure, Cense will be entitled to ask You to change the password.

You are prohibited from using any services or facilities provided in connection with this site to compromise security or tamper with system resources and/or accounts. If You become involved in any violation of system security, Cense reserves the right to release Your details to system administrators at other sites in order to assist them in resolving security incidents. Cense reserves the right to investigate suspected violations of these Terms of Use.

Cense reserves the right to fully cooperate with any law enforcement authorities or court order requesting or directing Cense to disclose the identity of anyone posting any e-mail messages, or publishing or otherwise making available any materials that are believed to violate these Terms of Use.

By accepting this agreement, You waive and hold harmless Cense from any claims resulting from any action taken by Cense during or as a result of its investigations and/or from any actions taken as a consequence of investigations by either Cense or law enforcement authorities.

That the Customer agrees that his/her personal data can be used for internal testing and development purposes in order to make continuing improvements to the Services availed on Cense.

Cense shall take all reasonable and prudent technical precautions so as to safeguard the database of the Customer (data and information provided by the Customer). The Customer agrees that Cense shall not be liable/responsible in the unforeseeable event of complete or partial loss and breach of the database for any reason whatsoever.   

The customer / user understands that Cense would be sharing their data to it's lending partners for the purpose of getting a loan offer. In this process, the "partner" of Cense would be making a Credit Bureau "Hard Pull" to assess the customer's profile. Cense maintains a list of it's partners at https://Cense.com/partners

Procedure: Any and all disputes and/or grievances regarding the present Terms of Use have to be resolved following the procedure available at https://Cense.com/privacy-policy

Censeshall not be liable for any failure or delay in performance of its obligations under this Terms of Use arising out of or caused, directly or indirectly, by circumstances beyond its reasonable control, including, acts of God; earthquakes; fires; floods; wars; civil or military disturbances; acts of terrorism; sabotage; strikes; epidemics; pandemics; riots. So as to claim the benefit of this provision shall, Cense as soon as reasonably practicable after the occurrence of any such event, (a) provide written notice to the other Party of the nature and extent of any such Force Majeure condition; and (b) use commercially reasonable efforts to remove any such causes and resume performance as specified under this Agreement as soon as practicable.

The interpretation, performance and enforcement of this Terms of Use will be governed by the laws of India without giving effect to any choice of law or rule that would cause the application of the laws of any jurisdiction other than the laws of India to the rights and duties of the parties. The laws of India and the courts at New Delhi, India shall alone have jurisdiction.

If any provision of this Terms of Use or the application thereof is held to be invalid, void or unenforceable for any reason, the remaining provisions not so declared will be construed so as to comply with the law, and will nevertheless continue in full force and effect without being impaired in any manner whatsoever.

Neither party to this Terms of Use shall seek to have any term, provision, covenant, or restriction of this Terms of Use to be held invalid. This Agreement shall inure to the benefit of and be enforceable by the successors and assigns of Cense, any person or entity which purchases substantially all of the assets of Cense or with whom Cense merges, and any subsidiary, affiliate, corporation, or operating division of such entities.

Cense reserves it 's right to amend, change, add, or delete any and all clauses/terms and conditions of this Agreement at its discretion. You shall be required to keep a regular check and update yourself with any and all changes, additions, amendments, deletions and otherwise that Cense shall come up with time and again to revise these Terms of Use. You voluntarily agree and understand that there shall be no specific intimation from Cense on such changes and revisions. As of the effective date of the revised Terms of Use, You will be considered as having consented to all changes and revisions to these Terms of Use.
